By purchasing, accessing, or using the El Arte de Amarte program, the user acknowledges and agrees to the following terms:

 

1. PERSONAL USE OF THE PROGRAM

The purchase of El Arte de Amarte grants solely a limited, personal, individual, and non-transferable right to access and use the content included in the program during the applicable access period.

The purchase does not constitute the acquisition, assignment, or transfer of any copyright or intellectual property rights in or to such content.

2. PROTECTED CONTENT

The original content comprising the program, including videos, audio recordings, meditations, texts, exercises, activities, presentations, downloadable materials, graphic resources, masterclasses, and other original materials, is protected by applicable intellectual property and copyright laws.

Purchasing the program does not grant authorization to reproduce, distribute, publish, sublicense, or commercially exploit any such content.

3. PROHIBITION AGAINST SHARING ACCESS

Each purchase is intended exclusively for one individual.

Sharing usernames, passwords, private links, downloadable files, or any other means that would allow a third party to access all or part of the program without having legitimately purchased such access is prohibited.

Where there is reasonable evidence of unauthorized use, access may be suspended or terminated in accordance with these Terms and applicable law.

4. REPRODUCTION AND DISTRIBUTION

5. DIGITAL BOOK EL ARTE DE AMARME

As part of the program, participants may be provided with a digital copy of the book El Arte de Amarme exclusively for their personal use.

El Arte de Amarme is a work by María Fabiola Passariello registered with the United States Copyright Office under Registration No. TX 9-598-015.

The delivery or download of the file does not constitute an assignment or transfer of copyright in the work, nor does it authorize its reproduction or distribution.

It is strictly prohibited to copy, share, publish, distribute, sell, resell, upload, or otherwise make the complete file or protected portions of the work available to third parties without the applicable authorization, except as permitted by applicable law.

6. MEDITATIONS, AUDIO, AND VIDEO CONTENT

The meditations, audio recordings, videos, and other audiovisual content provided as part of the program are exclusively for personal use.

They may not be recorded, reproduced, published, distributed, resold, incorporated into other courses or programs, or used for commercial or professional purposes without the prior express written authorization of the applicable rights holder.

7. PROHIBITION OF COMMERCIAL EXPLOITATION

Purchasing the program does not grant a license to teach, commercialize, sublicense, or incorporate its protected content into your own courses, workshops, therapies, professional sessions, programs, publications, or products.

Any commercial use requires prior express written authorization and, where applicable, an appropriate licensing agreement.

8. SESSIONS

Individual sessions, group sessions, classes, meetings, and other activities conducted as part of El Arte de Amarte may not be recorded, retransmitted, published, or distributed by participants without authorization.

Where other participants are involved, their privacy, image, voice, and confidentiality must also be respected.

9. INFRINGEMENT AND LEGAL ACTION

The unauthorized reproduction, distribution, publication, commercialization, or exploitation of protected materials may constitute copyright infringement and/or a breach of these Terms.

Where legally permitted, the applicable rights holder may suspend or terminate access and pursue available legal remedies in the United States and/or any other jurisdiction having competent authority.

Depending on applicable law, such remedies may include claims for actual damages, profits attributable to the infringement, injunctive relief, costs, attorneys’ fees, and other available remedies.

Under U.S. law, where legally applicable, statutory damages for certain copyright infringements may reach up to USD $150,000 per work where the infringement is determined to be willful.

The reference to USD $150,000 is a notice of potential legal consequences available under U.S. law and does not constitute an automatic fine, penalty, or debt imposed by El Arte de Amarte, Despertar el Ser, or María Fabiola Passariello.

The existence, nature, and amount of any liability shall be determined in accordance with applicable law and the jurisdiction having authority over the matter.

10. RESERVATION OF RIGHTS

All rights not expressly granted are reserved by their respective rights holders.
